Welcome to HelpForSure. You may use our services through our website www.helpforsureapp.com (“Website”) or our mobile application (“App”). Our Website and App have been created to provide information about our company and services to the visitors and users of services. For the purpose of these Terms of services, the term 'HelpForSure' or 'Us' or 'We' refers to HelpForSure. The term 'You' refers to the user or viewer of our Website and/or App. When You use any of the Services provided by Us, including but not limited to, Mobile Repair, Laptop Repair, Plumbing, Pest Control, Professional Cleaning etc., you will be subject to the terms and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Services. By entering and using our platform you agree to comply with these Terms of services.

Acceptance of Terms


•These Terms of services set forth legally binding terms for your use of our Platforms. By using, visit, accessing our platforms, you agree to be bound by this Terms of services, whether you are a “Visitor” (which means that you simply browse our Platforms) or you are a “Subscriber” (which means that you have registered with HelpForSure as a user). If you do not accept the Terms of services, you should leave the Website and/or App and discontinue use of the Service immediately.
•We may modify these Terms from time to time, and such modification shall be effective upon its posting on our platforms. You agree to be bound by any modification to this Agreement when you use our Website and App after any such modification is posted; it is therefore important that you review the Terms of services regularly.

General Registration Requirements


•For your use of our platforms, you certify that you are at least 18 years of age for a binding contract and are barred from receiving services under any law in force in India or other jurisdictions, if applicable. You also agree to furnish accurate and complete personal information while registering on our Website or the App to avail the Services. You hereby also agree to promptly update your Personal Data to keep it current and complete.
•If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, We reserve the right to suspend or terminate your account and refuse any and all current or future use of our Website and App (or any portion thereof) at any time. HelpForSure will not be liable for any act or omission arising from the inaccurate information provided by You to Us.
•You may access our Website and App as available:
•for your information and personal use;
•as intended through the normal functionalities of HelpForSure.
•You will be required to enter a valid mobile number and email address at the time of registering on our Website or the App as a subscriber. By registering your phone number with us, you consent to be contacted by us via phone calls and/or SMS notifications, in case of any subscription/service updates. In addition, if at any time you wish not to receive any future communications or you wish to have your name deleted from our mailing lists, please contact us on info@helpforsureapp.com. If you are registered with the DND National registry you may not receive any promotional messages from us.

Subscription: Account, Password and Security


•While registering on HelpForSure, you will be required to choose a password. You are responsible for keeping your password and account information as confidential. Moreover, You are entirely responsible for all activities that occur under your subscription. You agree to:
•immediately notify Us of any misuse of your account or any other breach of security
•never use any other Subscriber’s account without prior authorization from HelpForSure
•HelpForSure will not be liable for any loss or damage arising from your failure to comply with this Agreement.

User Information


•HelpForSure is constantly improving its services and the overall user experience. In future, We will provide You services based on your location in a short span of time. To facilitate this, You hereby authorize HelpForSure to use the location based information provided by any of the telecommunication companies when You use the mobile phone to make a booking. The location based information will be used only to facilitate and improve services for You.
•While using the Website or the App, You agree that Your user information through Your mobile telecommunication device may be communicated to us, and we may obtain information about Your mobile carrier, Your mobile device, or Your physical location. You hereby agree that You are responsible for all charges and necessary permissions related to accessing the App through Your mobile access provider.
•HelpForSure reserves the right to collect user data including name, contact information and other details to facilitate the Services or use of its App to avail Services.
•Compiled data about the user accounts, including but not limited to contact number and e-mail addresses, are owned by HelpForSure.
•If the system is unable to establish an unique identity based on the data (mobile no., email address etc.) input by You, the account shall be indefinitely suspended.
•For quality, training and auditing purpose, We may record your telephone calls to Us.

Termination or Suspension


•You give your conscious consent that HelpForSure holds right to terminate your access to the App or Website or restrict or suspend your access to all or any part of the Website or the App at any time, for any or no reason, with or without prior notice, and without liability.
•HelpForSure holds the right to terminate Your service booking(s) at any time without giving any reason whatsoever.

Preservation/Disclosure


•You acknowledge, consent and agree that HelpForSure may access, preserve and disclose your account information and content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to:
•comply with legal process nationally or internationally;
•enforce these Terms of services;
•respond to claims that any Content violates the rights of third parties;
•respond to your requests for customer service;
•protect the rights, property or personal safety of HelpForSure, its subscribers and the public; or
•be pursuant to the terms of the Privacy Policy.

Security Components

You understand that our Website and App and software embodied within the Website and App may include security components that permit digital materials to be protected, and that use of these materials is subject to usage rules set by HelpForSure and/or content providers who provide content to HelpForSure. You may not attempt to override, disable, circumvent or otherwise interfere with any such security components and usage rules embedded in our platforms.

HelpForSure and Third Parties

HelpForSure expressly disclaims all responsibilities for third party links, which You may be able to access through the App or the Website. Third parties could be advertisers, affiliate partners, strategic partners, or others. We do not warrant the products or offerings of, any of these businesses or individuals, or the accuracy of the content of their websites. Moreover you should review the applicable terms of services and policies for such websites before You use them. Also, in case you decide to access any such linked Website, you do so at your own risk.

Compliance with Applicable Law

You hereby agree that You shall not use the App and Website for displaying, hosting, modifying, distributing, sharing or storing any material without HelpForSure’s written consent. Doing so should not:
•Violate any applicable law or regulation,
•Infringe the copyright, trademark, trade secret or other intellectual property or proprietary rights of others or violate the privacy, publicity or other personal rights of others,
•Be harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, threatening, abusive or hateful or racially, ethnically objectionable, disparaging, relating encouraging money laundering or gambling or otherwise unlawful in any manner whatsoever,
•harm minors in any way,
•deceive or mislead the addressee about the origin of such message or communicates any information which is grossly offensive or menacing in nature,
•impersonate another person or entity,
•contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of HelpForSure’s computer systems or site or HelpForSure’s users, customer’s computer systems or site,
•threaten the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states or of public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or insulting any other nation.

Usage of Services


•For safety and security reasons it is utmost important that you ensure the active supervision of service providers should the service required by you requires the entry of our professionals into Your premises. HelpForSure only connects its customers with professionals and will not be responsible for any loss or damage to property or person during the service.
•For any concerns or questions with respect to the services availed, You agree to revert to us within the time specified for the category of services availed.
•All invoices and payments due to HelpForSure must be cleared immediately upon completion of the task or on the submission of the invoice, whichever is earlier.
•You agree to not solicit the services of the service provider. HelpForSure will not be responsible for service quality and overall professionalism of the service professionals if You have engaged the services of such service provider without HelpForSure’s written consent.

Intellectual Property Rights

HelpForSure is the sole owner of the App, Website and all software created to facilitate the services to You. HelpForSure provides You with a single limited license that is specifically personal, non-transferable, and non-exclusive. All content on the App or the Website, which is including, but not limited to, designs, text, graphics, images, video, information, logos, button icons, software, audio files and any other content (“Content”) are the exclusive and sole property of HelpForSure. You agree to not copy, reproduce or use such Content without attributing HelpForSure for its ownership. The unauthorized copying, modification, use or publication of these logos, thumbnails and images is strictly prohibited. In addition, use of the Content for any purpose not expressly permitted by HelpForSure in this Agreement is prohibited and may invite legal action.

Disclaimer of Warranties and Liability


•HelpForSure does not warrant that:
•This Website or the App will be constantly available, or available at all; or
•The information on the Website or the App is complete, true, accurate or non-misleading;
•The services will meet the customer’s requirements.
•HelpForSure shall not be liable to you in any way or in relation to the Contents of, or use of, or otherwise in connection with its Website and App. HelpForSure does not warrant that the contents in the Website or the App are free of viruses or other harmful components.
•Although we encourage you to notify us of any complaints that You might have with the quality and professionalism of service providers availed through Us, We shall not be liable for any conduct or behaviour or actions of service providers.
•For any spare parts or materials, HelpForSure’s Service Providers may assist you in procuring the same. However, in all such circumstances, HelpForSure is not responsible for nor does HelpForSure make any warranties as to the quality or fitness of the spare parts or materials. All issues and concerns with the quality of the spare parts / materials should be with the manufacture or seller.
•Subject to applicable laws, in no event shall HelpForSure’s or its affiliates' aggregate liability arising from or related to the services exceed the payments actually received and retained by HelpForSure from you for the paid services liability for any and all causes of action brought by you or your agents.

Indemnity

You agree to defend, indemnify and hold harmless HelpForSure, its subsidiaries, affiliates, subcontractors, officers, directors, employees, consultants, representatives and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees and costs) arising from:
•your use of and access to our Platforms;
•your violation of any term of this Agreement;
•your violation of any third party right, including without limitation any copyright, property, or privacy right.
These Terms of services and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by HelpForSure without restriction.

These Terms of services together with any other legal notices published by HelpForSure on its Platforms, shall constitute the entire agreement between you and HelpForSure concerning its Website and App and governs your use of our Website and App and Service, superseding any prior agreements between you and HelpForSure with respect to our Website and App and Service.
The failure of HelpForSure to exercise or enforce any right or provision of these Terms of services shall not constitute a waiver of such right or provision. If any provision of these Terms of services is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms of services remain in full force and effect.
These Terms of services shall be governed by the laws of India, without respect to its conflict of laws principles. Any claim or dispute between you and HelpForSure that arises in whole or in part from our Website and App shall be decided exclusively by a court of competent jurisdiction located in Bangalore.

Force Majeure

You hereby agree that HelpForSure shall not be liable for any damage/loss or deficiency in performance of our services under acts of nature, forces or causes beyond our control, including but not limited to Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures.

Appliances


•Warranty/guarantee on spare parts would be as described on the materials' bill. Please insist for a material bill from our professional, if he is procuring the materials for you.
•Any appliance which is repairable would be insured only upto the repair amount or the amount mentioned above or the depreciated value'.
•You agree that You shall not directly contact our professional regarding a job booked through us, as in such cases HelpForSure has no control over the situation or condition. All warranty and service assurance offered by HelpForSure, in such case, stands null & void.

Plumbing


•Warranty/guarantee on spare parts would be as described on the materials' bill. Please insist for a material bill from our professional, if he is procuring the materials for you.
•You agree that You shall not directly contact our professional regarding a job booked through us, as in such cases HelpForSure has no control over the situation or condition. All warranty and service assurance offered by HelpForSure, in such case, stands null & void.

Electrician Services


•Warranty/guarantee on spare parts would be as described on the materials' bill. Please insist for a material bill from our professional, if he is procuring the materials for you.
•You agree that You shall not directly contact our professional regarding a job booked through us, as in such cases HelpForSure has no control over the situation or condition. All warranty and service assurance offered by HelpForSure, in such case, stands null & void.

Carpentry

Computer/Laptop Repair

•Any appliance which is repairable would be insured only upto the repair amount or the amount mentioned above or the depreciated value'.
•You agree that You shall not directly contact our professional regarding a job booked through us, as in such cases HelpForSure has no control over the situation or condition. All warranty and service assurance offered by HelpForSure, in such case, stands null & void.

Pest Control

Please be aware that it usually takes 3-4 days for the treatment to start taking effect and 12 days for complete outcome

Home Cleaning


•Before initiating the job at your premises, please confirm with HelpForSure professional the areas included & excluded for the service that you have selected.
•We strongly advise you to make sure that all your belongings are carefully kept in a secure location. Please make sure that any sensitive material is carefully moved under your supervision only. Also, when our team is leaving your premises, please make sure that you have thoroughly checked the entire home.

Other Terms and Conditions


•Service Evaluation and Quotation: Quotations made by our repair technicians is only an assessment based on the fault description you have provided to us. There are cases that the price of the repair of the unit becomes higher than the estimated price. These usually occur when the fault description provided to us was inaccurate, or in the event that we found other faults in your unit. When these instances occur, you will be contacted personally to further discuss the details and the price of repair for any faults we find.
•Minimum Charge for Repairs: All mobile repairs are subject to a “minimum charge”. The minimum amount charges cover our repair specialist’ time and any parts used to attempt to repair on the unit. After thorough inspection of the unit, the minimum charge will become due:
•When it would be cheaper for you to purchase a new mobile than fixing your old one or mobile unit is “Beyond Economical Repair”.
•When we provide a new repair quotation and you refuse this quotation.
•Turn Around time: Mobile Repairs usually take 3-5 days from the date they arrive at our repair center, this apart from the time taken to deliver the unit which is beyond our control. During peak seasons, repairs can take much longer to be fixed and processed.
•Repair warranty: Most of our repair service carries a limited warranty, which will be communicated to you. In the event that a repair on your unit becomes faulty within the set warranty period, please send the unit back to us with a copy of the receipt or Ref. No. We will conduct a thorough investigation and respond within 3 working days. If the problem is from the initial repair, we will conduct any further repair free of charge. If the unit reveals further glitches not related to the original repair or due to parts not replaced in previous repair we will contact you and discuss the matters and let you make a decision with regards to the cost.
•Unpaid repairs: All units after they are either fixed declared beyond economical repair or require a re-quote will be held for 45 days maximum. We will make reasonable attempts to contact you by phone and email a minimum of 3 times. If no payment was received within 45 days, the unit will be auctioned to recover the costs of repairs made.
•Accessories, Power Supplies: Please do not send any accessories in with your repairs unless we have specifically requested them. We may request the charger or power supply for a power related repair. We cannot be held responsible for any loss or damage to accessories whilst in our possession (SIM cards, memory cards, chargers, boxes, cases, cables, mount etc.). On occasions we may ask for certain accessories to be sent in after our initial diagnosis for further testing as they may be related to the fault.
•User’s Data and Information Losses: We will do our best to retain all data your unit has, but we cannot be held responsible for any lost data. Please make certain that you have all important mobile data has a backup before sending it to us.
•Payments: We will notify you by email about Payments once a repair has either been completed successfully, if the unit has been deemed beyond economical repair or you refuse a re-quote. Cheque payments are subject to approximately 5 working days clearance delay. We also accept payments via Cash and Mobile wallet.
•Complaints: We always try to keep our customers satisfied, and our complaint resolution system helps us to ensure that our customers are always satisfied, even when things go wrong. For any complaints or suggestions, please contact us either by email or by letter. Upon receiving your complaint, we will investigate every detail to see what went wrong and resolve it to your satisfaction.
•We agree to Acknowledge any complaints we receive within 5 working days
•Advise you on how long it will take to resolve the complaint
